Gas Industry Co and the Commerce Commission (Commission) recognise that they share certain common interests in relation to their respective statutory functions in the gas industry. In August 2011, a Memorandum of Understanding was developed. This memorandum explains how Gas Industry Co and the Commission intend to coordinate their respective roles under the Gas Act and the Commerce Act.
The Vector Transmission Code (VTC) provides for Gas Industry Co to act as the appeals body under the VTC code change process. To provide greater certainty and transparency on how this role will be performed and, in particular, how Gas Industry Co will work with Vector Gas Ltd (Vector) and parties appealing decisions made by Vector in relation to VTC Change Requests, the following Memorandum of Understanding between Gas Industry Co and Vector was developed.
The Maui Pipeline Operating Code (MPOC) provides for Gas Industry Co to make recommendations in respect of MPOC Change Requests (sections 29.4 and 29.5). To provide greater certainty and transparency on how these roles will be performed and, in particular, how Gas Industry Co will work with Maui Development Limited (MDL) and parties seeking amendments to the MPOC, the following Memorandum of Understanding between Gas Industry Co and MDL (MPOC MoU) was developed. In 2016, when First Gas Limited (FGL) acquired the Maui pipeline, the MPOC MoU was novated to FGL at which point FGL assumed all of the previous rights and obligations of MDL under the MoU. The novation agreement is also provided below.
